PURCHASE OF A CAR
IMPORTANT JUDGMENT. \ _____ MOTOR COMPANY NON-SUITED. (Bv Telegraph,—Press Association.) WELLINGTON, Tuesday.. Holding that certain conditions of the hire purchase agreement used by Dominion ■ Motors, Ltd., amounted to a penalty, and that the Court should grant relief, Mr Page, S.M., in a reserved judgment, non-suited the company in an action claiming the full amount of outstanding promissory notes, £256 14s 9d, due on a car handed back. The company claimed that under the terms of the agreement, it was entitled to the full value of the outstanding promissory notes, plus interest and insurance. I in noting that the car had been returned and that £345 had already been credited to the purchaser in part payment of a car bought for £741 14s 9d, Mr Page remarked that' the case was one of considerable importance and no little difficulty.
