SOLICITORS IN TROUBLE
ONE STRUCK OFF ROLL. APPEAL COURT DECISIONS. (By Telegraph.—Press Association.) WELLINGTON, Friday. The Court of Appeal delivered reserved judgment to-day in the case of the Law Society v. Athol Howarth, of Te Kuiti, for alleged shortage in trust accounts. It ruled that the practitioner be struck off the rolls. An order was made accordingly, with costs to the Law Society. Not Struck Off. The Court also delivered judgment in the case of the Law Society v. Cecil Michael McDavitt, of Morrinsville, charged with misappropriation of trust money. It stated that there ( were many circumstances which justified the Court in refraining from striking this solicitor off the rolls. The Court accordingly refrained from doing so, upon M-cDavitt’s counsel’s undertaking that practitioner would for three years promptly comply with all the proper requisitions of the District Law Society. McDavitt was ordered to pay costs and expenses. Case from Te Aroha. The Chief Justice delivered judgment in the case of the Law Society v. John Charles Carroll and John Ponsonby Somers. . The Court unfavourably commented on the practitioners’ delay in complying with the requisitions of the Law Society, but considered the case to be adequately met by the suspension already undergone by the practitioners, and they were ordered to pay costs, 50 gns.
