COLLISION IN DUST.

CHINESE HELD LIABLE. FINE OF £3 IMPOSED. A plea of not guilty to charges of negligent and dangerous driving and failing to keep to the left was entered by a Chinese fruiterer, Lee Young, of Hamilton, in the Magistrate’s Court to-day. Young collided with a car driven by Alfred Harold East, of Forest LcfEe Road, on the Hamilton Ngaruawahia Road recently. Constable Murray deposed that lie arrived on the scene of the accident about 4 p.m. East said that he was travelling about 7ft. from the grass. When the constable arrived East and Young were conversing and he beard East say “ The best tiling for Young to do would be to buy the car for £35 as he had already had an offer for that amount aqfl now he had ruined the car.” Constable Murray also heard East blaming Young for the accident while Young was disclaiming all responsibility. In the box Young stated that he passed Ling, another Chinese, who was driving in front of him, about 4 miles from Hamilton. When witness rounded the bend he could not see East’s car owing to the dust. He did not think he was responsible for the accident, although he admitted that he paid compensation to East and visited East’s children.

After hearing further evidence Mr Wyvern Wilson, S.M., said the cause of the accident was “ too much speed and too little heed.” He thought Young was travelling too close to the car in front, especially in view of the dusty nature of the road. If Young had applied his brakes and kept to the right side of the road he could have avoided East’s car.

Senior-Sergeant Sweeney withdrew the other charges, after his Worship expressed the view that Young was driving in-a dangerous manner. Accused was lined £3, with costs 16s, fop dangerous driving.
