BUS WITHOUT LICENSE.
A TEST CASE.
CONVICTED WTH COSTS
'in the Hamilton Magistrate's Court this morning, before Mr Wyvern Wilson, S.M., Clifford Walter Francis Trethowen was charged with being the owner of a motor omnibus without being the holder of a license to run in that capacity.
Mr F. A. Swarbrick appeared for the prosecution, and defendant was represented by Mr W. J. King. A plea of guilty to the charge was entered by Mr King. Mr Swarbrick pointed out that defendant held a taxi license and ran a bus with seating accommodation for seven. He had started a motor omnibus service without the necessary license. The case was all the more serious as other licensed services were being run in the town and these had to pay heavy license fees and conform with regulations to comply with the Act. It was therefore grossly unfair to these services for defendant to carry on without such a license and without fitting up his bus to comply with the Act. Mr King pointed out that he understood that the prosecution did not press for heavy penally, as it was primarily a test case. Mr Swarbrick agreed.
It being a test case, His .Worship stated that.he would convict defendant and order him to pay costs.
