CIVIL CLAIM,

A SHAREMiLKING AGREEMENT. JUDGMENT FOR PLAINTIFF. A claim for £22 12s 3d was made in the Magistrate’s Court at Hamilton this morning by Neil McLeon and P. Flannagan, sharemilkers, ’ against J. Mathers, farmer of To ltapa, for moneys allegedly due under agreement. Mr W. King, who appeared for plaintiffs, staled that (he claim was made by them as sharemilkers who bad been employed by defendant and sought payment in respect of Ihcir proportion of the monthly milk cheque for June as well as their proportion of the proceeds from pigs sold and £3 1 (5s Id withheld from them for the payment of manures from which allegedly they received no benefits. The plaintiffs disputed defendant’s statement of what ho. should have paid them.

The arrangement made was that they should go on to the To Rapa farm on the basis of half shares as it was near the end of the season, while an agreement was made hi connection with manure, plaintiffs accepting the condition lhat they should pay half the cost- of manure for top-dressing. During their employment as sharemilkers the manure was not used for topdressing but for cropping, and they held they should nol he liable.

The defence was a denial of plaintiff’s interpretation of the application of the agreement, but after hearing evidence llis Worship gave judgment for £3O 17s 3d for plaintiffs, the amount including all costs.
