AGENTS’ QUALIFICATION.
PAYMENT FOR SERVICES. MAGISTRxYTE’S DECISION. (By Telegraph’.—Press Association.) WELLINGTON, Friday. An agent who is by law required to possess a particular qualification to enable him to act as such is not entitled to any remuneration if at the ■time he rendered the services lie was not so qualified. This authority was quoted by Mr Page, S.M., in giving judgment in favour of defendant in a claim for £5 5s by J. Taylor and Co., and H. M. Stowell, native agents, against Amihana Ileta, for work done in the preparation and engrossment of a power of attorney in favour of defendant. It was never executed, however, as intended. The executor would not sign. The magistrate held that giving, as it did, power to borrow money from a mortgagee and to execute securities containing powers of sale it constituted a form of conveyancing, and plaintiffs were neither solicitors nor licensed land brokers.
