A MATTER OF COMPENSATION. WHO SHOULD PAY? (Times Correspondent.) WELLINGTON, Tuesday. When Martin Robert Tier injured his right knee as Ihe result of an accident in July, 1924, he thought ho had recovered in January of 1925, but when he started work again (he is a watersider) he met with another accident, being then employed by the Commonwealth and Dominion Line. At the time of the first accident, he was employed by the New Zealand Shipping Company. The question as to which company was responsible for Tier's compensation payments was before the Arbitration Court to-day, when Mr Justice Frazcr adjourned the case until Tier could be operated upon.

Mr Frazer said that as far as he could sec the New Zealand Shipping Company could not be held liable. When the first, injury to the knee look place Tier received over £BO In weekly compensation from the company. When he resumed work, this time under the Commonwealth Line, he slipped and again injured his right knee. Since then he had been totally disabled and this would continue, he had been advised, for a further indefinite period. He had received only a small amount from the Commonwealth Line, the company refusing further compensation on the grounds that the incapacity was due to a continuation 6f the first injury while in the employ of. the other company. It was said by Ihe New Zealand Shipping Company's solicitor that it had been laid down both at Home and in New Zealand, that the first employer was not liable for the injuries of a second accident, even if, at the time of the second accident, there were evidences of partial disability.
