MEETING OF CREDITORS
AN UNUSUAL CASE. (Times Correspondent.) DUNEDIN, Tuesday." A meeting of creditors in the estate of Michael Bernston, of Dunedin, tailor, was held, and was presided over by the Official Assignee (Mr E. W. Cave). Four creditors attended. The circumstances, which were rather peculiar, were that bankrupt had been a tailor in Dunedin in 1892, and had filed his schedule. In 1921 he. was carrying on 1 business at Kaitoke in the North Island, under the name of Bcrnie, and he had incurred liabilities there and was bankrupt. The Assignee in the north discovered that the man had been made a bankrupt in Dunedin in 1892, and wrote to Ihe Assignee in Dunedin about the matter. The Assignee at Dunedin replied that the man had never obtained his discharge in conneclion. with his first bankruptcy, and that he (the Assignee of Dunedin) claimed the assels from the second bankruptcy, for the benefit of the creditors concerned in the first' bankruptcy. The man was prosecuted in the North Island for leading under another name, and not notifying his creditors that he was an undischarged bankrupt, and he received a month's imprisonment. The Assignee in the North Island realised the assets and sent a note or the proceedings to the Assignee at Dunedin. The latter had to get authority from the Dunedin creditors to pay the costs incurred in the second bankruptcy in Ihe North Island, and a resolution w.-.s passed authorising him to pay Ihe costs, the balance to be divided amongst the Dunedin creditors.
