LOCAL BUILDER FINED.

SCAFFOLDINQ ACT BREACH. At the Magistrate’s Court yesterday afternoon the Scaffolding Inspector (Mr A. D. Snedden) proceeded against W. W. Scott, builder and contractor, of Hamilton (Mr J. F. Strang) for failing to give 24 hours’ notice in writing of his intention to erect a hoist in Victoria Street; also placing it in use without having first submitted same to a specified test in the presence of the Inspector. Mr Snedden stated that full particulars of his obligations under both the Scaffolding Act and its Regulations were supplied to Mr Scott in September last, but in spite of this he had failed to comply with the various provisions affecting the cases before the Court.

For the defendant, Mr Strang submitted that the Act and its Regulations were of fairly recent date, and his client had not been regularly engaged in the building trade for the past two or three years. The contract on which the trouble occurred Is his first job since re-entering this line of business, and it was pointed out that the inspector’s arrival on the job had been the cause of holding the works up for something like half a day, thus causing some little loss to the defendant. He therefore requested His Worship to take this into consideration in deciding upon the penalty.

A fine of £2 with Court costs 7s was inflicted upon the first charge and a conviction with 7s Court costs upon the second.
