AN UNIQUE PETITION.
UNDER MARRIAGE ACT. CONGRUITY OF AGE. By Telegraph.—Press Association. AUCKLAND, Thursday. An unique petition under the Marriage Act was heard by Mr JUstico Stringer in the Supreme Court, when Florence Ladybird Bingley, aged 18, of Manurewa, sought a declaration that her proposed marriage with John Penbcrthy, widower, -umbrella manufacturer, aged 48, was a proper one. The petition was opposed by the girl's father, William Bingley.
'Counsel for the 'petitioner said the sole question at issue was one of congruity of age. The parties were deeply attached to each other. Counsel 'for the defence said when the man was 00 and line girl 30 the latter -would notice the difference.
Ills Honor said the disparity in age was not ttoo incongruous. If he withheld permission the couple might drift into a dangerous intdmaoy; He judicially declared the proposed marriage proper.
