There shall.be.in anil for the Colony of New Zealand the several offices, -of. Colonial Secretary,. Attorney-General, Cojonial (Treasurer, Solicitor General, Auditor-General, and Secretary of Native Affairs.... ,■;:■";;- ---3. It. shall be.lawful lor the 'Governor of the ■ s?iid Colony-, in the name and oil behalf of Her Majesty, by>.warrant-,under, his ■hand, from time to tiilie; to appoint such fit,persons; aa he; in his discretion shall think fit to hold such offices respectirely, and (except-as hereinafter mentidn'ed) from time to time in his -discretion to revoke such appointments,-•> or any of : them; ■ and i-.o'mnke new appointments in lieu- thereof. Provided nevertheless that it shall not be lawful for the said Governor to reradvo any person from the office of Auditpr-'Qc'ric'riil* except upon an address, from either the Legislative 'Council or the House..of Rr|.)resentat'ivea|. praying '/'of such removal. .-Provided also..that .no person shall he qualified tjo hold the office of AuditorGeneral who'shairat-'thb saitie time be a Member of the Executive Council, or of tlie 'Legislative Couscil, or of the House of Representatives, the ! office of Auditor General sliall immediately thereupon,- ipso facto, become vacant. 4. : Every such appointment revocation anil new appointment shall be notified in t the.Government Gazette for- the Colony.within. one week after the same.shall havejuken place. 5. And whereas for enabling Her Alnjesty to mnke due provision for the payment of siich officers, anil otherwise for -the establishment of the 'GinerarGp'vernmeht of her ssid Colony of New Zealand, Her Mujesty's most 'dutiful' and loyal subjects, the Gobamoris of New' Zealand, assembled in their House of Representatives, have, in testimony of their unfeigned ;aQVction to Iter Majesty's person and GovernmCut,'freely resolved to grant unto Her Majesty a certain reveniie.payable out of the Public Revenue of the snii'l Colony": Beit therefore-enacted as .■':•-.. ' -■■■". , ~ In lieu and instead of the sum of .£4:700 so reserved and made payable as hereinbeforementioned under the said recited Act of this Imperial Parliament, there shall be paid to Her Majesty, her heirs and successors, out of the Revenue arising from all Taxes, Duties, Rates and Imposts raised within the said Colony by virtue of any Act of the General Assembly, and from the disposal, of the Waste Lands of the Crown in New Zealand, the sum <&'& for defraying the'charge of the respective ser* vices mentioaed-in the -Schedule to'this Act: and such sums shall- be issued from rtiine' to time'by:the .Colonial .Treasurer, or other the Receiver or Receivers .of such Revenue Upon the.' waijrant of the Governor of the said Colony tinder liis band t anil all sums so issued shnfl be accounted for in siich manner as Her:.
