Tho witnesses foe tho defeuco contradicted fho consiahle'ii stateiuonts ns to tho ladruuko used by the accused. In (jiving judgment tho S.M. stated that it was no part oi a constable's dutv to push a man about unless in taping a orowd back at. a public gathering. His duty was to either arrest or summons, as tho caso required.- . Tho> constable hud brought on tho assault by bis own action and therefore the wholo ot the charges would be dismissni]. The charge against, H McGrory and J. McShoonfor inciting Wilkinson to resist tho police, am! •foiling to assist when called ou in the Kinfi'i name, wore also dismissed.
