The Corporation’s liability hinged on the legal point as to whether the roadway was a permanent one or not. The Court expressed the opinion that it was not a permanent thoroughfare within the meaning of the City Corporation Act, and counsel for the claimant applied to have a case stated for the rail Court. The application was granted, and the ease was adjourned until August I, until the Full Court’s decision has been given.
