SUPREME COURT SITTINGS.

(Before Mr. Justice Edwards.) BRISCOE AND OTHERS v. BARTRUM This case, a claim made for bushfelling, was concluded on Saturday afternoon. After the evidence of defendant, E. A. Campbell, D. Mason and W. Connor gave evidence for the defence. About five o’clock, the Court was adjourned to enable the parties to confer. No agreement was come to. Mr. Cohen did not call further evidence and submitted his case for judgment or a quantum meruit, claiming a deduction of the amount of damage as estimated by the defence. His client had no desire to ovade payment of what was properly due to the men, and was quite willing tq pav the value of the work they had done. His Honor said he would have nonsuited the plaintiff had Bartrum not written the letter “knocking off” the plaintiffs. Judgment was- given for plaintiffs for £6O, in addition to the £3O already paid on account, and on condition that Bartram paid the men’s stores account of £sl 10s. Costs were not allowed because the action had not been dealt with by the Court in the way in which it was brought. The claim was for £3OO.
