Alfred Deakin, in explaining the Judiciary Bill, said 'the -right of appeal to the Privy Council from the High Court was taken away. There was 'provided an, appeal by grace, 'with the consent of three of five Judges, comprising .the. High Court. He, however, had no doubt that within -a few years 99 out of every 100 casefi, which now went to the Privy Council would remain- ill -Australia, and the High. Court w,ould practice ally be" the final Court of Appeal. He in* , tended to draw the" best- Judges' from all parts of -Australia, to -form the Federal Bench. .
