TAUERU HOTEL.
JUDGMENT FOR DEFENDANTS. (By Telegraph —Press Association.) WELLIN'GTON ; Tuesday. 1J is Honour, Justice MacGregor, gave judgment to-day lor defendants m the caoc oi John Thompson, lormer proprietor of the Taueru Hotel, in connection with the former ’s claim for breaches of alleged contract arising out of Hie sale of the hotel to a man named Palmer.
After counsel had addressed the Court, llis Honour took the unusual step of delivering an oral judgment. He had listened to both sides and felt that the result was clear enough to enable him to give judgment immediately. The Judge said lie was not satisfied that the facts, as alleged by' the plaintiff, had been proved. There was no doubt tautthere had been delay in the fulfilment of contract, but Thompson himself had been the cause. The difficulty of obtaining the license had undoubtedly been due to him. His Honour was also of the opinion that up to the beginning of August Treadwell and Sons, solicitors, had recognised Palmer ns the principal party in connection with the bargain of December. There was only one meaning to be taken from all the circumstances. He was not satisfied that a verbal contract had been proved. Plaintiff had elected to sue Dwans, knowing at the same time that they could have sued Palmer, the present occupier of the hotel. They had accordingly brought themselves within the Statute of Frauds, but lie was quite satisfied, even if the contract had been proved, it was unenforceable because of the Statute.
