AN INCIDENT OF A CUP

VICTORY

The win of Blue Ribbon in the Wellington Cup, and the promise of a hat to the tniiiier if the mare pulled off the evLMit, were matters which cropped up in a case heard by Mr L. G. Reid, S.M., at the S.M. Court this morning, when Patrick Hamill claimed from P. G. Rose and Walter Garrett the sum of £15 ;>s, the value of a Panama hat. Mr J. M. Coradine appeared for plaintiff, Mr O. Pragnell for Rose, and Mr G. H. Cullen for Garrett.

Plaintiff stated that Rose told him that if Blue Ribbon won the Cup he was to give Garrett one of the best hats in plaintiff's shop. Blue Ribbon won the Cup, and on the authority given by Rose, he had supplied a Panama hat to Garrett.

Rose denied plaintiff's statements. He did not authorise Hamill to give Garrett a hat, and he had had no conversation with plaintiff about the hat before the Wellington Cup was run. He had returned all the accounts forwarde-d to him by Hamill. He had personally returned three. He had never authorised Garrett to get the hat. He had a conversation with Garrett after the mare had won the Wellington Cup, Garrett having approached him and said, "I suppose I'm on a new hat over this." Witness replied, "'I suppose so, but I'll see about it. " Subsequently Gai-rett told him that, he had obtained the hat, but witness had had no conversation with Garrett about it. Walter Garrett, horse trainer, stated that Rose, Hamill, F. Dorset (owner of Blue Ribbon) and he were together, when Rose asked how Blue Ribbon was doing, and stated, "If you keep her good and win the Cup, as I have 000 to 3 on her, you can get the best hat Hamill has got. "Rose told Hamill to give him the hat if the mare won the race. Subsequently Rose spoke to him, and asked him if he had obtained the hat. Witness said he had not, but would do so. His Worship stated he had no doubt but what Mr Hamill's evidence was correct. He gave judgment aganst Rose for the amount claimed, with costs £1 2s.
