A DISPUTED CLAIM.

CADE V. STEVENS.

Before Mr Huselden, S.M., at Mastcrton this morning, J. D. Cado sued J. Stevens, of Carterton, for £7 8s 9d for carting timber. Mr C. A. Pownall appeared for plaintiff and Mr W. Or. Beard for defendant.

Mr Pownall, for plaintiff, said the circumstances were that his client had carted certain timber for Mr Stevens from the property of Mr J. Hessey, payment for which was now disputed, a disagreement between the parties as to the quantity carted having arisen. Evidence in support of the claim was given by plaintiff who was then carting timber from Mr Hessey's to Mr Stevens' mill at one shilling per hundred feet. He had kept tally of the timber carted by girth measurement in the ordinary bush style. Mr Stevens maintained that all the timber carted by plaintiff went to one man, but this he denied, other persons having received quantities to plaintiff's knowledge.

To Mr Beard: Understood that all the timber went to one man. Mr Potts, Mr Stevens' bookkeeper, had notshown witness any memorandum of timber sent- elsewhere. Another man named Kiddie wns carting for Mr Stevens on day-work pay, and kept a tally of iiis own, Would positively swear that timbersupplied to Messrs Blinkborne, Ridgway, Stevens, and Wellington came from Hessey's bush, and none of it from Wrigley's bush, Judgment for £2 2s Gd, with costs.
