Aug 13. MAGISTRATE'S COURT.

(Before D. Macfarlane, Esq., S.M.)

Wednesday, Aug 13th.

At the S.M. Court to-day, M. M. and E. Lawaon claimed £12 from James Corbett for hire of horses. The plaintiffs deposed that the defendant, who did not appear, had ill used and badly fed their horses • Judgment for plaintiffs with costs 35s 6d.

Constable Ryan charged Wm. Staccy with having stolen 13 rails valued at 7s fro-n Mr John Andrews' tramway, on the Hokitika road. Defendant admitted the charge, but said he considered the rails were of trifling value. He would pay for them. Mr. Andrews, in his evidence deposed that be had lost some 76 rails. He marked some ; and subsequently found them on Stacey's trasa. This led to the information being laid. S.M. Macfarlane, in convictiug accused, said that in consideration of previous convictions he would sentence the accused to 14 dajs' hard labour. The accused would likewise have to pay 7s costs and 15s cartage. :
