SIX HIT IN CRICKET CAUSES LITIGATION; MAY GO TO THE LORDS
LONDON, Nov. 3—A six hit by a Manchester cricketer may involve an appeal to the House of Lords and costs of £50(10. The Court of Appeal, by a majority, awarded £lO4 damages to Miss Bessie Stone, aged 53, who had claimed against the Gheetham Cricket Club, Manchester, because a ball hit out of the club's ground hit her on the head. Miss Stone had appealed against the dismissal of her claim by Justice Oliver, who held that there was no negligence or public nuisance by the club, and that the hit had been an exceptional one. Lord Justice SingleUn held that because balls had been hit out pf the ground before the club knew there was a risk and should have taken reasonable care to avoid injury to anyone on the highway. Lord Justice Somervell, who dissented, gave leave to appeal to the House of Lords. The action will have cost £5OOO when it has been heard by the House of Lords.
