DECREE NISI ANNULLED

AUCKLAND DIVORCE CASE [l’er Press Association) AUCKLAND, Oct. 6. A decree nisi made by the Court on February 27 last was annulled this morning by Mr Justice Johnston, and the petition was dismissed. The parties were Martin Billich White and Mary Georgia Billich White, and the decree was granted in February on the petition of the husband on the ground of his wife’s failure to comply with an order for restitution. Subsequently the Solicitor-General intervened, and this morning he was represented by Mr V. R. Meredith, who said that the facts were admitted and it was unnecessary to call evidence. He added that in view of the fact that the agreement of separation then in existence was not placed before the Court the decree nisi must go.

His Honour said that he understood the facts and the decree was annulled.
