OVER ADVANCE ON BUTTERFAT. I Per Press Asbocialion.] NELSON, June 28. A decision of interest to dairy far. l ory suppliers was given by Mr. Maunseli, S.M., in the defended case Waim<»a Dairy Company. Ltd., v. William Max. being a claim for £3 15s 5d in respect to the refund of an over-ad vance made on butter-fat supplied to the company. The magistrate held that the company was entitled to recover from defendant the amount either for money paid under mistake of fact or upon the ground that tho provisions of Article 17 arc an implied term of cont raet. Leave for appeal was granted.
