CONVICTION UPSET
NEW GUARD LEADER CRITICISM OF MR. LANG FULL COURT’S JUDGMENT Telegraph—Press Association—Copyright* Received Al ay 19, 9.5 p.m. {SYDNEY, May .19. The State Full Court dismissed the appeal by the Crown in the Eric Campbell case arising out. of a speech by the New Guard leader in which he scathingly criticised Mr. Lang, who was not present on that occasion. The magistrate convicted Colonel Campbell of using insulting words, and a certain policeman, giving evidence, said that tho words used by Colonel Campbell were insulting to them. Colonel Campbell, upon an appeal, upset the conviction and the Crown then appealed, the decision thereupon being given to-day The Chief Justice, delivering the judgment of the Full Court, said that the Statute was not meant to punish persons for using words calculated to insult persons not present or uttered where there were no persons present, closely connected with the person said to be insulted. The appeal, therefore, would bo dismissed. Tho decision is regarded as most important in legal circles.
