Watson, S.M., on Wednesday. The Waimarino County Council claimed the balance of rates due for 1928-29 from E. R. Beckett. Beckett admitted he had used the land in question to run stock on, as it adjoined other blocks held by him. The land came under the provisions of the Wanganui River Trust Act, 1891, which was administered by the Wellington Land Board. The plaintiff alleged that the land had reverted to the Crown. He did not have a lease of it and it was argued that he was not liable for county rates although his name was on the valuation roll as occupier of the sections. Counsel contended that the land was held under license even though there
wag not a lease nor any term of occupancy. It was pointed out that according to certain authorities the right to graze did not create an interest in land as occupier. Numerous cases were quoted by both counsel and the magistrate reserved his decision until next court day.
