RAETIHI LAW SUIT AN ALLEGED LOAN [ Per Press Association. ] WELLINGTON, Alarch 22. The Appeal Court (Sir Charles Skerrott an t d Judges Adams, Reeid andMacGregor), has before it J. F. O’Connor, of Racti.hi, versus W. E. Waldegrave, of Raetihi, solicitor. Appellant claimed from respondent and \\. 11, Tustin £olB 3s and interest, balance of a loan advanced to them in 1923 when in partnership as solicitors at Raetihi. The partnership was afterwards dissolved and an arrangement made by which appellant took a mortgage from Tustin for the balance due, and Waldegrave guaranteed that, he would pay £450. part of which had been paitJ. Juidgc Ostler held that by the agreement with Waldegrave appellant harl given up all his rights under the original loan an<l dismissed the case against Waldegrave. The appeal is against this decision. Air Spratt appeared for appellant and Alessrs Young and; Virtue for respondent. The appeal was dismissed.
