WANGANUI CITY COUNCIL SPECIAL ORDER ACCEPTING SURRENDERS AND GRANTING NEW LEASES NOTICE IS HEREBY GIVEN that al a Special Muting of the Wanganui City Council duly convened and held nt ‘k« Council Chambers St. Hill Street Wanganui on Tuesday the 23rd day of December 1924 the following resolution (intended to operate as a Special Order) was duly passed: — WHEREAS bv the various Deeds of Lease being the respective dates sot out in the first column of the schedule hereto made "between the Mayor Councillors and Burgesses of the Borough of Wanganui of the one part and the various persons whose names are set out. in the second column of the said schedule of the other part wbidi said basis are now vested for the residue now to'come and unexpired of the term of years created by the stud leases rcspcc. tivelv in Hie persons whose names are set out in the third column of the schedule hereto (hereinaftercalle. II lessees”) the lands comprised in the said Deeds of Lease respectively as particularly described in th< fourth column of the said schedule were respectively demised and leased to the persons whose names are respectively set out in Ilin second column of the said schedule for the respective terms of years and at lhe respective rents in the said I oeds of Lease mentioned AND WHEREAS by Proclamation duly gazetted in the New Zealand Gazette Number 40 nt page 1399 dated the 12th dav of June 1924 the Borough of Wanganui as constituted at the date of such J reclamation wn» declared a Citv under the name of the City of Wanganui and the lands affected by the said leases subject t <>t he term of vears respect ivelv created therebv are now vested in the Mayor Councillors and Citizens of the < tty ot Wanganui (hereinafter called “the Citv”) AND WHEREAS the respective lessees have each requested the <’ity to accept a surrender of the respective leases of the lands held by them respectively ami to grant new leases of the said lands respectively to Hie respective lessees thereof in the manner for the term and upon the covenants conditions and terms hereinafter appearing NOW THEREFORE the Wanganui City Council in pursuance and exermse of t in it by The Municipal Corporations Act 1920 and of all other powers enabling it in this behalf DOTH HEKikBYi RESOLVE by way of Special Order: — 1. To accept a surrender of the various leases particulars whereof are set out in the schedule hereto and to grant to the lessees respectively a new lease of the lands comprised in the said leases respectively upon the following terms and conditions: — (a) The term of each such now lease to bo for the period set out. in the fifth column of the said schedule* (b) The rental to bo paid in respect of the said lands to bo the sum set out in the sixth column of iho said schedule and such rental to be paid half-yearly on the. first days of Anril and October in each year of the said term. (c) Each new lease to contain: — (1) A covenant for the granting of renew als in perpetuity at an annual rental to bo fixed bv valuation of the lands only without taking into consideration the value ot any buildings or improvements then existing on the said lands for successive periods of tvyenty-onc years. (2) The same covenants mutatis mutandis as are contained in leases of that portion of the City of AVanganui formerly known as t.he Town Belt now granted by The Wanganui City Council and such other covenants conditions and provisions as are contained in the present lease to be surrendered as aforesaid or are authorised by the said Act. * (3) The form of the s. id n. wI. ■ani i Im covenants and provisions therein to be settled by the City * Solicitor. • (4 > I’he lessee to pay all costs and charges incurred in the preparation and advertisement of the Special Order and in connection with the preparation and execution of the said new lease.
