Mackay, Esq., ' Solicitor,, Wanganui. , You v. Woodham. . Dear Sir,-— '. I have handed to Mr Woodhanf your letter dated 28th November, which you sent to him through me. My client instructs me to say that he thanks you for the offer contained in that letter to settle for £17 18/6, the judgment you have against him, and to give him reasonable time to pay. With the assistance of kind friends he is now able ~to pay this sum. He prefers this course to being under any furttter obligation to you. I now enclose my cheque for £17 18/6. He could have satisfied the amount of the judgment only by selling his horse and cart and his furniture. This would have deprived him of his means/of livelihood. My client instructs me to say that- he fails cttft see why he should have been made the scapegoat because of the publication by the "Chronicle" of me letter you wrote to him. He has Incurred considerable loss of time diid expense in defending the action. il» that letter you claim from him £100, He could not gather from your letter that you did not intend to prosecute your claim by action.' -He is not aware of any insinuations haying been made against you. However, I am instructed to say, with deference that ,if it be the law ttiat you were not under any obligation whatever to avoid what was admittedly a fcure accident, ' under the circumstances of a main highway jjeing so unlighted, and there beiffg no footpath for pedestrians, he asks, me to suggest to you that as Mayor, you should use your influence to :se-, cure footpaths for main highways, so that men like him carrying on their business and having to drive on this or similar highways should not be in a position of incurring expense if an accident befall. My client is sorry that you should have been caused pain and inconvenience, but is'apprehensive that under similar conditions he and others may again find themselves in difficulties. —Yours faithfully, LOUIS COHEN.
