The discussion w,as the outcome of a reply received from the Education Department to the Council's request for a statement of the legal posi-t-on of the attitude takea up by the Senate in regard to the engineering course, it was stated in reply that it was contrary to the practice cf the Department to give legal ifdvice to statutory bodies which had their own legal advisers, and. moreover, that'in any case tho Department., could not see its way to interfere between the Senate and the College Council. Mr. Mahoii moved that, tho matter should be referred to the Council's legal advisers. Mr. Peacocke, in seconding the motion, pointed out that the Conncil had only iasked that Auckland students should hive a two years' course at the local University College. Professor ficgar said the position was that the Senate could not legally act .against its own statute, However,' he would vote for the motion. Mr. Peacocke said it was riot a question of lco-al right, but moral right. Mr. Beattv said that if it was proved that the action of the Senate was prejudicial to the University College, it was open to tho Council to endeavour to have the Senate's authority limited. The motion was carried -unanimously.
