TAILORING TRADE TRICKS.

CASE BEFORE ARBITRATION COURT.

(Per Press Association.) WELLINGTON, September 2. What was described by Mr Le Cren, Inspector of Awards, a* a seiioua case or a breach, of the tailors award was heard by His Honor Mr Justice S;m and Messrs S. Brown and J A McUillough in the Arbitration Court today.

Clause 7 m the award provides that all besopke work shall be done in tho shop of the employer for whom the same is performed, and for whom cr by uhom the order is taken. Proceedings were- taken against Glass and Lewis, tailors by the Department on Uie ground that they had committed a breach of this clause in taking orders rrom various persons between June and .Oecpmbgf* lasjb year/1 and KaviiW tho garments made up in a factory contrary to the award.

Mr Levy, on behalf of tho respondent Lewis, stated that the partnership had been dissolved between the twoparties. A breach of the awa^d was adadmitted, but Mr Glass was the partner really responsible, as Mi Lewis was always outride, travelling to obtain orders. He would ask the c:mt for leniency as Mr Lewis was inncc?nfc in the matter.

Mr Le Cren described the shon run by the respondents in Taranaki Street in tho latter half of 1907 as a mere blind. No work was done there. Oiders wore talron for suits but all clothes ivero made in tho factory. In six months €170 14s 3d had boon paid the factory for tho make-up of garments, which were "old as tailor-made. They were taken-from the factory in an unfinished condition for a "try on," then returned marked, (for alteration. He considered Mr Lewis must have had some knowledge of tho proceedings. ~ T*p Court held that i L was impossible, from tho siatement of fncl made by tho Inspedoi, to IWievo that a breach fnd be-M) committed without th« know-, (edu.o cf Mr Lewis. 1^ must suffer for what his partner, had done, a fine of £0 and costs would bo imiosed.
