THIS LAY. (Before Mr Von Sturmer, RM, and Mr P H Wood, JP). Thomas Quinlin was charged by Constable Eocletfn with a breach of the Police Offenders’ Act, being drunk and disorderly in the public streetn. Fined 5s or 8 days. W Hughes, same offence, fined 20s and costs, having been cautioned before. M Bourke, some offence. Fined ss. W H Reeves was charged with assaulting A Haywood, a railway guard and also impeding same in the discharge of his duty on the 26th instant, at the Greytown Railway Station. Constable Eccletou conducted the proseeutian. A Haywood (plaintiff) gave evidence ; he deposed that he was in the act of removing some timber obstructing the engine on the line near the railway station, when prisoner assaulted him three times, the first time striking him with a piece of board ; prisoner was the driver of a timber waggon and was loading trucks with timber just before the assault. Mr Tate, for defendant, cross examined the plaintiff at some length to show the position of the obstructions. To Mr Wood—We (plaintiff and I) had no previous quarrels. W. Whiterod, engine driver, gave evidence corroborating the previous witness’s evidence; also that plaintiff was assisting to shunt trucks when the timber was found to be iu the toad. A Clarke, the fireman, gave similar evidence ; believed prisoner first threw a board at plaintiff, and then struck him with his fists. Convicted of an unprovoked assault, and fined 40s and costs or seven days ; also, fined for obstructing a railway servant, £5 or fourteen days. E. Orbell v. J. Tully, alleged breaon of the Rabbit Act. Adjourned for one month on application of defendant. A civil case, dispute about chaff, G. Kempton v. Cox—Judgment was given for defendant, with costs.
