CANTERBURY DEFENDANTS TO PAY.

(By Telegraph. Press Association.) HAMILTON, Wednesday.

Reserved judgment has been given by Mr Justice Herdman in the case in which Frederick Edwin Bishop lock, farmer, of Eureka, sought specific performance of agreement in respect of the purchase of his property at Eureka, known as “Waverley Islands,” against Henry Martin Boyle and James Glenny Boyle, contractors, of Christchurch. The action involved a sum of over £22,000. The defence was based on the grounds that plaintiff had not obtained the written consent of the Public Trustee as was required in one of the covenants. His Honor found that defendants agreed to purchase the equity of redemption, and contracted to take the property, subject to existing mortgages, His Honor was unable to discover anything which entitled them to be released from their bargain. Judgment was therefore given for plaintiff, with costs on the highest scale as in an action to recover £IOO, witnesses’ expenses and v disbursements to be settled by the registrar. Second counsel was also certified at a fee of £lO 10s.
