LOVING CUP’S DEATH.
ALLEGATIONS OF NEGLIGENCE. DECISION RESERVED. AUCKLAND, September 16. The ease in which £7OO is claimed as damages for the shooting of the racehorse Loving Cup, allegedly in mistake for the injured horse Glen Maree was continued in the Supreme Court. The plaintiffs were Mervyn Wells and James Taylor, of Cambridge, and the defendant was Norman Austin, proprietor of the Te Papa boiling down works. It was alleged that negligence on the part of defendant or his agent was the cause of Loving Cup being shot. Several witnesses for plaintiffs stated that Loving Cup was not suffering from injury. Witnesses valued the horse at £750. For defendant, witnesses said the horse had an open wound and was walking as though it were sore. The hearing was finished late to-night.
