“ Testatrix Mentally Powerless.”

DUNEDIN, July 21. Holding that testatrix was physically and mentally powerless to resist the execution of will or to express a wish including unwillingness or reluctance to sign, Mr Justice Kennedy gave judgment against plaintiff in a case in which Father Ardagh, a Roman Catholic priest, made an application for probate of the will of the late Catherine Cosgrove, of Gibbston.

The action was brought by Father Ardagh for probate, appointing him executor and leaving the estate subject to a life interest for a brother of testatrix, to the Roman Catholic Bishop of Dunedin, to be divided and expended upon charitable purposes. Some of the next-of-kin opposed and some supported the will, and others submitted the matter to the judgment of the Court.
