Quesfion of Payment Out of Stake. Her Press Association. DUNEDIN, August 1. Mr Bartholomew, S.M., gave judgment to-day in the case brought by Robert Geen, of Oamaru, against Matthew Henry Dawson in respect to the sale to the lattter of the mare Elite Bingen. The point in dispute was the sum of £SO, which -was to have been paid to the plaintiff out of the first stakes won. The legal point at issue was one of joint interest or “ contingency,” and the Magistrate held that, by plaintiff’s signature to the registration form notifying that his contingency expired on July 31, 1932, he debarred himself from now alleging to the contrary. Judgment was entered for the defendant.
