WORKER SUES CROWN FOR COMPENSATION.
STRAINED HEART WHILE SHIFTING CORN SACKS.
Claiming that while in the employ of the Railway Department at Lyttelton he suffered partial incapacitation from work through straining his heart, Arthur Henry Mills, waterside worker. Lyttelton, proceeded against ■ the Crown in the Arbitration Court this afternoon for compensation. Mr Justice Frazer presided. With him were Mr W. Cecil Prime and Mr A, L. Monteith. Mr Gresson appeared for Mills, and Mr Brown for respondent. The statement of claim set out_ that suppliant was employed by the Railway Department at Lyttelton on February 8, 1929, and while working in a railway truck, strained his heart, and was partially incapacitated, for which he had received £221 15s 8d in compensation at the rate of £3 8s 5d a week. He claimed further compensation such as the Court might see .fit to direct. The Crown admitted that Mills had strained his heart while working in a raiiwav truck, and that he had been partially Incapacitated as a result, but denied that he was entitled to compensation. Giving evidence, suppliant said that he was shifting bales of com sacks, which were being unloaded from a vessel to a railway truck at Lyttelton, and was suddenly taken by a giddy turn. He had to cease work tempor. arlly, but was able to resume after a rest. Subsequently he obtained medical advice, being told that he had strained his heart. (Proceeding.)
