EXTRADITION PAPERS IN BIG TEXAS CASE ARRIVE AT AUCKLAND.
(Special to the “Star.”) » AUCKLAND, October 25. The extradition papers in connection with the arrest of John Grey, the land agent who was arrested at Helensville on September 25, arrived in Wellington by the Tahiti on Tuesday. Grey was charged under the names of A B. Crouch and J. M. Cameron with being a fugitive criminal within the Extradition Act, 1870, a warrant for his arrest having been issued in the State of Texas in 1916.
The papers were sent to the ConsulGeneral for America in Wellington and were forwarded to the American Consul in Auckland, Mr W. F. Boy l e, who handed them to the Crown Solicitor yesterday. The Act provides that if a foreign warrant of arrest is duly authenticated, and evidence is given, which accoiding ( to English law would justify committal for trial, if the accused has not yet been tried, or would prove conviction if he has already been convicted, the Magistrate will commit him for extradition. After committal for extradition every accused has fifteen davs in which to apply for a writ of habeas corpus, and after such a period or at the close of the habeas corpus proceedings, if they are unsuccessful, the Governor-General issues a warrant for surrender and the accused handed over to officers of the foreign Government.
Grey appeared before Mr Hunt, S.M., in the Magistrate’s Court on Wednesday, but as the extradition papers had not arrived he was further remanded until next Wednesday, in custody.
