LATE SPORTING

In connection with the Ellesmere Oountv Trotting Club’s meeting on Thursday, the following penalties have been imposed. Ellesmere Handicap— Dixie Mac lsec and Macushla- 4.sec; Blackwater Handicap. Macushla 3sec. TAMA-A-ROA. DISQUALIFICATION REMOVED. (Per Press Association - .) WELLINGTON, April 16. In the matter of the appeal by P. A. Sweney, owner of ttie horse Tama a-Roa, against the disqualification of the horse Tama-a-Roa under part 24, rule 4, of the Rules of Racing, consequent upon the disqualification of S. Les. Boyes, the previous owner, by the Auckland District Committee, the judgment of the New Zealand Raring Club (given by Messrs C. P. Skerrett, O. S. Watkins and Wm. E. Bidwill) is as follows : “ This is a case in which P. A. Sweney states that be purchased the horse Tama a-Roa from S. Les Boles m perfectly good faith and without any knowledge whatever that a breach of the Rules of Racing had been committed by Boles prior to the date of the sale of the horse. Boles, the previous owner of the horse Tama-a-Roa, was some months after the sale by him to P. A. Sweney, disqualified by the Auckland District Committee for the term of three years from March 15, 1923 for corrupt practices, committed by him on or about March 11 and 12. 1921. Under part 32, rule 4, of the Rules of Racing it is provided that no horse of which a disqualified person is, or of which he was at the time the offence was committed the owner, shall be qualified to be entered or to start for any race. Provision is also made whereby any person owning or having any interest in a horse which by reason of this rule has become subject to the disabilities therein specified may a peal to the conference, and the judges appointed to hear the ar>r>eal may confirm or remove the disabilities in whole or in part, o- grant such other relief to the appellant or make such order as to them may seem meet. We are satisfied that P. A. Sweney purchased the horse Tama a-Roa in good faith from S. Les. Boles, and we order the removal of disqualification of the said horse Tama-a-Roa as from the date of purchase from P. A. Sweney from S. Les Boles, namely. April 3, 1922. We direct that the deposit be refunded to the appellant.
