THIRD TRIAL ALLOWED.
GNGAROTG MURDER CHARGE.

In the Ongaroto murder trial, the Crown Solicitor applied for a new trial. Mr Hampton, for the prisoner, opposed the application. He said the prisoner had been in custody for four months with much mental strain of two trials. The third trial therefore was too great to bo contemplated. The evidence was purely circumstantial, and upon it there were two disagreements by careful, intelligent and unbiassed juries. Counsel contended that a fair trial could not be exjiectcd in either Hamilton or 4 Auckland, where the people all read the Press reports and the Judge’s summing-up.
His Honor said he would grant a third trials and the Solicitor-Generals would declare whether it* would be advisable to proceed.
If the Solicitor-General deems* it advisable, and a new trial is commenced, this will be the third time that Hakaraia *Te Kahn, charged with the murder of Richard Elliott at Ongaroto on Easter Sunday, has faced the Judge and jury. The Grown Prosecutor is Mr 3>avys Gillies.
