SALE OF A HOUSE.
AN OWNER’S RIGHTS. In tlio absence of a stipulation that an agent shall have the exclusive right to soil, the owner of a house may himself sell. Knowledge of tbo solo acts as a revocation of the agent’s authority to sell. Mr McCarthy, S.M., came to that conclusion after investigating the case H. 13, Sorensen, licensed land agent (Mr G. T. Weston) v. R. I. Duncan (Mr F. "Whitcombo), a claim for £l3 lbs, being commission on the alleged sale of a house, or in the alterp a live a similar sum as for services , rendered. Defendant sold the house himself, without any assistance from the agent. The plaintiff alleged that defendant consciously kept the fact of the. solo a secret, leaving him to continue fruitless exertions on defendant’s behalf. Mr M’Carthy found that the defendant informed the plaintiff’s salesman that the house had been sold, and that this announcement operated as a revocation of plaintiff’s authority to sell. Judgment was given for the defendant with costs.
