[Per Press Association.] DUNEDIN, October 3. v .Mr Bartholomew, S.M., gave Ids decision to-day regarding the recent charges preferred against, watersiders that, having use of certain pi <.-onsc?, they used the same as a common gaming house. The defence' raised was that the defendants did not have the ‘‘uso ’’ of the premises within the meaning that expression had in the Gaming Act, “ use ” connoting more than mere physical use- The* Magistrate upheld this contention in dismissing the cases.
