HARBOUR REGULATIONS.
TOWING LICENSES. At the Lyttelton Court this morning Mr Beetham gave judgment in the case heard last Court, day, when P. M'Conville, master of tiie s.s. John Anderson, was charged on the information of the Harbour Master with towing a vessel over 150 tons register, without being licensed by the Harbour Board. The judgment was as follows : — ; " These informations are laidiinder: Sections 38 and 39 of the harbour regulations.. ■Section 38. applies to vessels solely . employed within J any harbour, and .. X think Section 39 must be read in the stirne way. The. question arises, is this vessel one 3olely employed within any harbour ? This steamer is licensed under Section 189 of the Shipping ahd Seamen's Act to trade to Akaroa on the south and Gore Bay on the north, and. she does ply between these and intermediate places. There is no doubt the bulk of her trade is outside the har-: hour. That being so the vessel does not in my opinion come within the definition in Section 38, and the captain does not require a license under Section 39, which must, I think, be read with Section 38.; The informations will be dismissed with costs £1 ls on each information."
