Alleged Breach of Land Act.

[Peb 'Press Association.! I NEW PLYMOUTH, Feb. 28. The charge against Hendy, for making alleged false declarations under the Land Act, was called on at the Resident Magistrate's Court this morning. Mr j Boy appeared for the Crown, Mr Samuel for the defendant. Mr O'Hara Smith, Auditor in the Land Department, who is prosecuting, and the other witnesses were ordered out of Court during the hearing of the case. Mr Sidney Weltman, Commissioner of Crown Landß, was the first witneeß. He produced the Gazette proclaiming Section 5, Block 4, Hawera, opened for sale or selection under " The Land Amendment Act, 1887," area seven hundred and twenty acres. His examination ia now going on. Mr Sidney Weltman gave evidence as to the area of the land a person could take up, and. a copy of an opinion vrtiica had bean given in reßponee to a query from his predecessor was put in, though Mr Boy objected to it. Witness said there was a doubt about the land a person could hold till the opinion handed .in -was given. The witness refused to give any information relative to private communications he might have received from Mr O'Hara Smith. He did not know of any' declaration for land in his

office which applied to land over- the limit set down in his opinion. read. The forms need were produced." According -to -these a man could hold ior- cash 640 acres firstolass, and 2000 secondjolaßs in each land distriot. Section 6,, block 4t, Hawera district was second-class land. The Court has adjourned for lunch. .
