The Chief Justice and Justice Richmond gave -judgment in the Coui-t of Appeal in Che case of Aynsley aud others (appellants) v. the Church Property Tru&tees (respondent.'.) The question was whether the appellants as representatives of English debenture holders, should pay Property tax, or whether it ought no.t to be paid by the Church Property Trustees of Canterbury, who had issued the debentures. Tht'iv Honors held that .tho appellants were liable to assessment as Trustees of the mortgage, and were entitled to deduct the tax from interest accruing, duo for the period in respect of which the tax was payable. Judgment was therefore entered for the respondents with costs.
