Captain Crdll stated that the men had signed articles to go to Callao ; they, however, refused to go to jwork after Monday last, and they now also refused to go in the , ship. In defence the men made a rambling statement to the effect that the ship was not seaworthy. The Resident Magistrate said thia statement was untrue; his colleague, to satisfy himself, had' made an inspection o£ the ship, and he declared that' she was seaworthy, and that there was no risk. In the former case, he considered that the men had some excuse, but in this there was none; they had received a month's advance, which they had got cashed. The men, refusing to go on board, were sentenced to six weeks' imprisonment, with hard labour. civil case. •:■ i Hodge v. Croll.— Claim, £4 7s 6d. Mr Nalder for plaintiff, who stated that the amount claimed was for wages per day oa board the ship King of Italy, aa sailmaker. Defendant stated he engaged plaintiff, as sailmaker, at £7 per mouth, and he agreed to go in the ship at those wages ; had neter engaged him at per day. Judgment was given for jEI 17p 6d, plaintiff to pay his own coats.
