LYTTELTON.
Mondat, Oct. 26. Present— Councillors England, AUwright, | Ward, Woledge, Hargreaves, Chalmers, and Hawkins, tbe Mayor presiding. The minutes of former meeting were read i and confirmed. The following correspondence wasj-ead: — From the Proviucial Secretary, in reply to the application of the Council for aid in making the new nuisance road on Sumner Road, stating that the Government had no appropriation fund for that purpose. From the Mayor of Christchurch, asking for the opinion of the farmers as to alteration of the market day. From the Mayor of Lyttelton, in reply, stating that Lyttelton not being an agricultural district the alteration of the day would make but little difference. From Mr J. Hawdon, acknowledging, with thanks, on behalf of Mrs Hawdon, the testimonial to the late Mr G. Macfarlan, and ex- 1 pressing the deep satisfaction of Mrs Hawdon at the sentiments contained iv the testimonial. From the Secretary of the Hook and Ladder Brigade, stating that a practical trial of the two engines had taken place, and that Captain Roper suggested that 3t 0 feet of hose should be obtained: If this! were not done, the engines would be useless at any fire. The Clerk stated he had received two notices of appeal, which would be heard at the Kesident Magistrate's '. ourt on the 3rd proximo. Councillor Willcox, asked who was going i to defend the valuations. He did not think j that the defence of the appeals ought to be left to the valuer. It was resolved that the Solicitor and Town Clerk be present to assist him. The Works committee's report was read. It stated : — That the Governor Bay road was being proceeded with, and that eight labourers were at work on it. The two fireengines had been thoroughly overhauled, cleaned and oiled, and were now in efficient working order ; no work had been done in the town during the week except ordinary cleaning. The committee, in conjunction with the bathing-shed committee, on examin ing the site for the proposed platform at the bathing-place, considered it would be impolitic to have it done by contract, and they are having it done by the Council's labourers; the committee requested to be indemnified for this action, as a resolution of the Council of Oct. 19 directed it to be done by contract. On the motion of Councillor Ward, seconded by Councillor Hargreaves, ifc was resolved that the action taken by the Committee be approved. A request from Mr Pavitt asking the Council to decide on the new road to Brenchley Farm, was referred to tbe Works committee to report on at next meeting. With respect to the fire engines, Capt. Roper, stated he thought it would be necessary for the Council to ofler a premium, and institute a Fire Brigade, as in Christchurch ; he stated that the attendance at the testing of the engines was very small. Councillor Hargreaves asked what steps it was intended to take in the matter relating to ythe by-laws. A long discussion ensued, come of the members being of opinion that it was unnecessary to apply to the Attorney -General fjr his opinion. Councillor Hargreaves said he was not actuated by any personal feeling* ; he had met Mr Williams as the Provincial Solicitor, but being unsatisfied with his ruling of the Act, be would propose the following resolution : — "Thatthe Attorney General's opinion be obtained as to whether the Act of 1867 repealed the Lyttelton Municipal /\ctof 18ti3, and all provisions and by-laws made under that Act (see clause 182 J and also whether clause 184 had reference to repealing bylaws made under the LytteUon Municipal Council Act of 1863, or only by-laws created under the Act of 1867." Councillor Ward seconded the motion. Councillor England moved as an amendment : — " That instead of obtaining the Attorney General's advice, the Council's Solicitor be requested to furnish the Council in writing with detailed instructions for maturing and carrying through the Council in all its stages, any by-laws they may wish to adopt." Councillor AUwright seconded the amendment, which waa put and lost, the voting being 3 for, 6 against it. The original motion was then put, and carried. Councillor Hargreaves moved, and it was carried unanimously, " That a vote of thanks be recorded to Councillor Woledge for the
manner in which he . had engrossed the memorial to the friends of the late Mr D. Macfarlan. the motion of Councillor Chalmers, seconded by Councillor Woledge, it was resolved, "That future cases for the opinion of the Council's solicitor be stated in writing; and that the solicitor be requested to. give such opinions in writing!^? On Mr Willcox's motion, it was resolved. that the solicitor draw up the case for the consideration of the Attorney-General. Ace >unts, amounting to £40 4s ld, were passed, and ordered to be paid. Councillor Chalmer% havinpr altered the notice of motion standing in bis name, moved, " That application be made to bis Honor the Superintendent to appoint aulitois for the Borough, which was duly seconded and carried." Councillor Willcox gave notice of motion " that 300 feet of canvas hose be purchased for the town fire engine, dependent upon the Liverpool, London, and Globe Fire Insurance Company not removing their engine from tlie town ; and that the Council appoint aud assist the formation of a Brigade to take charge of and work the two engines." He referred to the last meeting of the Hook and Ladder Brigade, and pointed out the good the engines would do in case of a fire if the hose were obtained. Councillor Hargreaves seconded the resolution. Councillor Allwright said that unless there was a pro >er brigade the engines would be useless; he stated that the Hook and Ladder Brigade could not get a muster on their drill nights. The motion was carried. The tenders for the bathing shed were opened — Mr Buist, £17 5s ; W. Cummins, £16 10s. Mr Buist's tender was accepted. Councillor Hargreaves gave notice of motion "That the town be lighted during the ensuing year by contract, and that tenders be invited for that purpose, the contractor to find all necessary materials." Couucillor Chalmers gave notice of motion " That a hose reel be obtained in connection with the proposed new hose."
