SENTENCE VARIED.
APPEAL COURT DECISION. PRISONER'S APPLICATION. [By Telegraph. —J J r«ss Association] WELLINGTON, April 1). The Court of Appeal yesterday heard the case of the King versus Clement Robert Lawson.
Having been sentenced to one year's hard labour on each charge concurrently, at Auckland, in February, 1037, by Mr. Justice Callan for the offences of breaking and entering by night with intent to commit a crime, and being in the possession of housebreaking instruments, and being also declared an habitual criminal, the prisoner made application to the Court of Appeal for cancellation of that declaration.
The Court yesterday cancelled tho declaration that lie was an habitual criminal, but varied the remainder of the sentence to four years' hard labour.
