ALLEGED BREACH OF CONTRACT JUDGMENT FORi PLAINTIFF FOR Ml Us AND COSTS. . (Before His Honor Judge Kettle.) The case of Adolph (Paeroa) v. Messrs Clarkin, Hunt Nathan, and others "on behalf of °Ohineinuri Jockey Club, a claim for £112 17s 9d!' for balance alleged to be due on a contract let by the defendants to the plaintiff and a" claim for alleged breach of contract on the part of the defendants was continued at the District Court yesterday. Mr J. Miller (Thames) instructed by Mir Porritt (Paeroa.) appeared on behalf of the plaintiff. Messrs Thos. Cotter (Auckland) appeared on behalf of the defendant. Mr H. Poland (secretary of the Ohinemuri Racing Club) was present. . The jurymen chosen were Messrs J. Gibson (foreman), F. Ladner, H. Kirby, and Cook. After evidence for the plaintiff and the defence had been called, learned counsel addrsssed the Court, after which His Honor summed up, and the jury retired.to consider their verdict. After a retirement for some considerable time, |they returned a verdict for the-plaintiff. for £41 14s and costs £18 9s 3d, made up as follows: Witnesses expenses. £10 9s 3d, Court fees | £4 17s, and solicitor's fee, £3 3s. j His Honor entered up judgment ac detailed above, and the Court adjourned.
