A HARD CASE.
(To the Editor of the Evening Stab.) •Sißi-rrKnowing tbat you are. always foremost in denouncing oppression and injustice, I request that you will kindly insert the following.:—Some days ago a fummons was served upon an old arid infirm resident to appear yesterday at the Auckland E.M. C0urt., ..,, At the.time of sorviceih'e'bkiliff'wastold that the person to whom he was giving the summons •was not the person for whom it was meant, the htter being even described as a cab-driver, a calling never followed by the former ; the bailiff,was also told that thrdefendatifcresided at Ohincmun, but all^oiildnot'do'. The consequence was that this infirm old man was compelled to brave the winds and seas and proceed to Auckland, and on his appearing at the R.M. Court yesterday, it was proved that John was not. r the John required; but, to jop'the him, he w/is allqwed;cpsts ; from the; plaintiff. tThus' "it wiirbe seen that through the obstinacy or stupidity of a bailiff any person bearing the same name as a person summoned may be dragged frj^'his home and business to the de•^^ftgement of health^ and convenience. Does not isucn xequirp exposure ? - The same may occur to any one carrying on business or residing here.
