CASE DISMISSED
SHEEP STEALING CHARGE A charge of stealing a sheep the property of Charles George Poultney, which was preferred against Maurice John Hartnett, of Epworth, was dismissed by the Magistrate, Mr H. Morgan in the Temuka Court yesterday. Mr L. M. Inglis appeared for Hartnett and Sergeant M. E. Hill conducted the police proceedings. It was alleged that the defendant had been found in possession of a sheep belonging to Poultney. Poultney had yarded some wethers at the Temuka saleyards but one had gone missing. It was discovered with defendant’s sheep at the saleyards a fortnight later.
Mr Inglis submitted that there was no evidence of theft and questioned whether there was a charge to answer. In a reserved decision the Magistrate indicated that he considered that a prima facie case had been established
Evidence for the defence was heard yesterday. In dismissing the case the Magistrate said there was no doubt Poultney’s wether was mixed with Hartnett’s ewes, but there was no evidence to show that it had been stolen. It may have become mixed in the yards.
