ADMIRAL BYRD THE DEFENDANT By Telegraph—Press Association DUNEDIN, October 30. “This case represents an attempt to secure a measure of justice for a British seaman injured in the employ of the Byrd Expedition, put ashore at Dunedin, and abandoned to charity,” stated counsel for John Taylor Burt, who claimed, in the Arbitration Court, compensation from Admiral Byrd for injuries allegedly received in an accident on the Jacob Ruppert, and in a fall down a crevasse. The defence was that the Jacob Ruppert was not a New Zealand ship, and that plaintiff, if he suffered accident (which was denied), was not entitled to compensation under the Act. It was denied that the relation of master and servant existed, Burt being a joint venturer in the expedition, any payments being voluntary.
